C/TPAs to Consider

Following is a list of C/TPAs (Consortium/Third Party Administrators) who will order a return-to-duty test for CDL drivers (Step 5 on the Clearinghouse). SAPlist has spoken personally with each of these C/TPAs. By accessing a nationwide network of C/TPAs, they will identify a collection site near the driver’s location. They will make certain that a same gender observer will be onsite for an observed collection.

The Clearinghouse regulation prohibits a C/TPA from conducting follow-up tests for a driver who is not in a DOT position. The rule clearly states that a SAP’s follow-up testing plan must be administered only by a driver’s employer, when the driver is actually in a DOT driving position. All DOT follow-up testing is on-duty testing. A driver who is not on-duty cannot be tested.

This list is not an endorsement. It is an “information only” list. Drivers need to make their own decision, based on their research. Drivers can visit websites, communicate by e-mail, and make phone calls. Drivers should do whatever they need to, in order to find the C/TPA that will best serve them.

Caution: While you registered as an owner/operator on the Clearinghouse, the regulation does not permit a C/TPA to do anything about Step 6 on the Clearinghouse. It is fraudulent for a C/TPA to tell you that they will take you through Step 6. If follow-up tests are conducted when a driver is not employed, an  FMCSA auditor can decide to not accept any of those tests. In that case, the driver will have to repeat those wrongly-ordered follow-up tests when he eventually finds a job.

40.25 requires a new employer to request all return-to-duty information (return-to-duty test and follow-up tests) for the previous 3 years. If follow-up tests were conducted, those test result documents will have dates, making it easy for an auditor to determine that follow-up tests were ordered when the driver was not employed. Unfortunately, drivers who have paid for follow-up tests will have spent time and money needlessly.
